Abstract

WHY ENVIRONMENTAL DUE DILIGENCE IS SO IMPORTANT

Due diligence is the process prospective purchasers, and their lenders, undertake to ascertain the market value and avoid incurring liability in acquiring a particular piece of property. Due diligence may be in the form of business appraisals, real estate appraisals, stock transactions, or environmental exposures.

Environmental Due Diligence (EDD) - the focus of this report - is conducted to determine if there are any environmental concerns that may incur environmental liability, and if environmental issues are a concern, to conduct all appropriate inquiry (AAI) to mitigate such liability. Further, the presence of environmental issues can affect the value of a property and the cost of the transaction.
LENDERS, LIABILITY, AND REGULATORY CONCERNS DRIVE THE USE OF ENVIRONMENTAL DUE DILIGENCE

EDD is performed to mitigate potential environmental liability, meet various regulatory requirements, protect stockholders, and to satisfy lenders.

For many buyers liability is the overwhelming concern.
