Commercial Real Estate Transaction - Site with Underground Storage Tanks

Location: West Michigan

Legal counsel contacted BLDI regarding a transaction for a retail fuel and convenience store in Western Michigan. The transaction was complicated by the presence of 20-year old underground storage tanks (USTs) in use at the property.

BLDI developed a scope of work to investigate potential release(s) from the UST system to meet the needs of the transaction consistent with the coverage for the UST insurance policy. During the investigation, a release from the UST system was documented and the release was properly reported. A claim against the insurance policy was successfully supported by a strong team of BLDI and legal counsel to assure coverage.

BLDI's technical knowledge of UST systems, release mechanisms, and insurance coverage helped assure coverage for the release from a covered portion of the UST system at this site. The extent of soil and groundwater impact was defined and the corrective action plan was developed. The CAP system consists of an air sparge and soil vapor extraction system. As of March 2008, the system is nearing completion.

BLDI continues to maintain strong communication with MDEQ and the insurance company representatives.
