A historic, family-owned manufacturing company was sold as part of settling an estate. The site was a listed Part 201 site with known contamination both on-site and off-site.
To resolve the outstanding environmental liability of the legacy company and distribution of the remaining estate proceeds, a remedial action plan (RAP) was developed. The RAP utilized selective soil removal, institutional controls, and engineering controls to support closure of the site. As part of the RAP long-term inspection, monitoring and maintenance, including provision of a financial assurance mechanism (FAM), was required. BLDI worked with legal counsel to develop a 30-year FAM that satisfied the Michigan Department of Environmental Quality, the purchaser, their auditors, and the lenders.
The project has 24 years remaining in the long-term inspection, monitoring and maintenance.
