A historic family-owned manufacturing company was caught in a fight over control of the company after the death of the founder.

The site was a listed Part 201 site with known contamination in both soil and groundwater. The plaintiff had conducted a valuation of the business and had demanded resolution of the estate consistent with this value. The defendant counsel retained BLDI to determine whether a liability for environmental contamination at the property existed and to whether a value could be placed on this liability.

To resolve the outstanding environmental liability of the legacy company and distribution of the remaining estate proceeds, a conceptual environmental due diligence process and a conceptual remedial action plan were developed for estimating purposes. ASTM, AICPA, and FASB methods were used to develop, substantiate, and develop the environmental cost estimate.

The court affirmed the procedure and value developed by BLDI and utilized this value in finding for the defendant.
