BLDI was initially retained to conduct a peer review of work prepared by another consultant, call them Consultant F. Consultant F's work included cleanup design and environmental due diligence work associated with the sale of leased property.
Consultant F had recommended their remedy to include excavation of impacted soil inside an operating retail center with limited access and the use of restrictive covenants (RC). Although Consultant F was working for the current lessee, Consultant F provided confidential documents to the prospective purchaser contrary to prior assurances.
BLDI provided alternate recommendations, including a no further action alternative to the client. The consultant for the prospective purchaser had similar concerns relative to the safety and effectiveness of the Consultant F approach. BLDI impressed upon Consultant F and the client that the use of RC for Part 201 sites was not applicable for closure except within the context of a Remedial Action Plan (RAP).
The client selected the BLDI alternative of soil vapor extraction, due to the lower cost compared to the Consultant F approach and ability to continue to operate during the implementation of the soil cleanup. BLDIs peer review saved the client significant funds, mitigated likely structural impacts to the building, and met the clients business goal of continued operation.
